Trademark- Cambodia

Summary

The trademark application shall be filed with MOC in Cambodia. Cambodia trademark adopts first to file principle. After the trademark is registered in Cambodia, the affidavit of use/or non-use shall be filed within 5-6th year from registration date or from renewal date, or the trademark is vulnerable for being cancelled by third party.

Application Procedure

  1. Filing trademark application with MOC: MOC will firstly examine the formality of trademark application.
  2. Substantive examination: the trademark application in Cambodia will be examined substantively to check if it meets distinctiveness or conflicts with prior trademark. The examination takes about 6-12 months.
  3. Acceptance: The trademark application will be accepted after passing substantive examination.
  4. Publication and Issuance: After trademark application is accepted, it will be published 90 days for opposition purpose. If no one files opposition, then the trademark registration will be issued. The term of trademark right is 10 years from filing date, and can be renewed to next 10 years subject to renewal fee.

  2. International classification and designated goods/services
  3. Mark specimen in JPEG
  4. Power of Attorney(notarization is required)
