Patent- Registered Community Design RCD

Summary

One design application files with the European Union Intellectual Property Office (EUIPO) including 27 EU member states. It is possible to include several designs which are in the same international classification in one application.

The European Union (EU) member states: Germany, France, Spain, Italy, Netherlands, Poland, Slovakia, Sweden, Denmark, Portugal, Ireland, Finland, Austria, Czech Republic, Luxembourg, Belgium, Hungary, Romania, Greece, Bulgaria, Latvia, Lithuania, Malta, Cyprus, Estonia, Slovenia, Croatia.

Advantages

  1. It will be more cost-saving than applying for design applications in each European country.
  2. A single examination procedure, once approved for registration, can simultaneously obtain the rights in most European countries.

Application Procedure

  1. Composition: Diagram drawings and explain each drawing briefly.
  2. Review: Confirm the correctness of the drawings.
  3. Submit an application to the European Union Intellectual Property Office (EUIPO): Non-substantive examination system. The examination period is around 2-3 months.
  4. Decision of grant: A registered Community design is initially valid for five years from the date of filing and can be renewed in blocks of five years up to a maximum of 25 years. It is possible to renew part of design for multiple design registration.
